How to buy a house in Mallorca step by step

The property buying process in Mallorca starts with deciding how you wish to buy. We explain which options you have: buying by yourself or with the help of a real state agent.

Buying a house by yourself

You find a property for sale on the island and go through all the procedures on your own. Obviously a strong command of Spanish is highly desirable if you choose this option.

First of all, you have to sign a private contract with the owner. Secondly, you need to use the services of a public official notary (called “Notario”) who has the legal authority to carry out the purchase. The notary needs to witness the sale because without their signature there won’t be any official registration of  the property under  your name. This signature should take place 1 to 3 months after the signature of the first private contract.

With the help of a local real estate agent

This is definitely the best option, since they have a detailed knowledge of the island and the procedures, as well as the local language. This will give you complete peace of mind at every stage of process.

Real estate agents usually get a commission on the sale, so the purchaser doesn’t have to pay anything. However, notary fees, registry fees, legal fees and land transfer tax are paid by the purchaser. Real estate agents have a wide range of houses, so you can ask for precisely what you want.

This starts with the planning of what you want to meet all your requirements. After that you go through the site selection, which includes the search, registry and purchase of the land. While the first steps are being taken, you can go through the design of the project and the registration of the plans and getting the building permission.
